THECOMMISSIONOFTHEEUROPEANCOMMUNITIES,
HavingregardtotheTreatyestablishingtheEuropeanCommunity,
HavingregardtoCouncilRegulation(EEC)No315/93of8February1993layingdownCommunityproceduresforcontaminantsinfood(1),andinparticularArticle2(3)thereof,AfterconsultingtheScientificCommitteeonFoodandtheEuropeanFoodSafetyAuthority,Whereas:

informationontheachievabilityofmaximumlevelsincertainaquaticspeciesitisnecessarytorevisetherelevantprovisionsofAnnexItoRegulation(EC)No466/2001forthesecontaminantsincertainfoods.Therevisedprovisionsmaintainahighlevelofconsumerhealthprotection.

Regulation(EC)No466/2001shouldbeamendedaccordingly.
ThemeasuresprovidedforinthisRegulationareinaccordancewiththeopinionoftheStandingCommitteeontheFoodChainandAnimalHealth,

CommissionRegulation(EC)No466/2001(2)setsmaximumlevelsforcertaincontaminantsinfoodstuffs.Thesemeasures,asspecificallyamendedbyCommissionRegulation(EC)No221/2002(3),includemaximumlevelsfortheheavymetalslead,cadmiumandmercury.Itisessential,inordertoprotectpublichealth,tokeepcontaminantsatlevelswhichdonotcausehealthconcerns.Maximumlevelsforlead,cadmiumandmercurymustbesafeandaslowasreasonablyachievable(ALARA)basedupongoodmanufacturingandagricultural/fisherypractices.Onthebasisofnew

AnnexItoRegulation(EC)No466/2001isamendedassetoutintheAnnextothisRegulation.

ThisRegulationshallenterintoforceonthe20thdayfollowingthatofitspublicationintheOfficialJournaloftheEuropeanUnion.
